GENERAL Meta COMPETITION TERMS AND CONDITIONS

  1. The organizer of the competition is ART BRÜT Care GbR ( ART BRÜT ), Beetsweg 21, 22765 Hamburg. Meta is neither involved in the planning nor in the organization of this competition. By participating in the competition, participants release Meta from any claims and any liability in connection with the competition, as far as legally permissible. The sole contact person for the competition is ART BRÜT.
  2. The raffle content: The specific raffle content, the type of prizes and their number are described in the respective Facebook or Instagram post. Non-cash prizes cannot be paid out in cash. By participating in the competition, the participant accepts these conditions of participation without restrictions. The mechanics of participation and the participation period are described in the respective competition post.
  3. Persons aged 16 and over who are resident in Germany and Austria are eligible to take part. Employees of ART BRÜT and other persons involved in the conception and implementation of this competition are excluded from participation. Everyone who has complied with the participation mechanism and the closing date in accordance with the respective competition post is eligible to take part in the prize draw. Participation via third parties, e.g. competition agencies, is not permitted. Furthermore, each person can only take part once per competition post; repeated participation will result in the loss of eligibility to take part.
  4. The competition registration and participation mechanism is described in the respective competition post and must be received by the closing date stated in the post. Later entries will not be considered in the draw, regardless of the reason for the delay. ART BRÜT cannot be held responsible for any technical faults, in particular network, electronic or computer failures. A public profile on the platform used is also a prerequisite for participation.
  5. The content and mechanics of the competitions are described in the respective competition post. The winners will receive a private message no later than 4 days after the closing date. The winners must send a reply with their full name and Facebook or Instagram name within 3 days of receiving this private message. Otherwise, ART BRÜT is entitled to determine or draw a new winner. Further data (address, email...) will be requested as required by private message or email. If the data necessary to conduct the competition is not submitted within this period, ART BRÜT reserves the right to determine or draw new winners.
  6. The prize is not transferable.
  7. ART BRÜT's decisions in connection with the respective competition are final. Inquiries in this regard cannot be answered. ART BRÜT reserves the right to suspend the competition completely or temporarily, in particular if any difficulties arise that endanger the integrity of the competition.
  8. Any liability for damages on the part of ART BRÜT and its bodies, employees and vicarious agents arising from or in connection with the competition, regardless of the legal basis, is excluded and, insofar as legally permitted, is limited to cases of intent or gross negligence. No liability is accepted for legal or material defects. The winner will be announced without guarantee.
  9. ART BRÜT assumes no procurement risk. The organizer reserves the right, at its own discretion, to replace an unavailable prize with a comparable prize.
  10. In the event of a breach of these conditions of participation, ART BRÜT reserves the right to exclude persons from the competition (even without giving reasons).
  11. As part of this competition, participants authorize ART BRÜT to publish images on Facebook and Instagram after appropriate agreement and to use them for their own advertising purposes free of charge. License claims cannot be asserted.
  12. Legal recourse is excluded.
  13. ART BRÜT reserves the right to change the respective conditions of participation at any time.
  14. The collection and processing of personal data for the purposes of carrying out this campaign is carried out by ART BRÜT Care GbR, Beetsweg 21, 22765 Hamburg. The legal basis for the collection of personal participant data is your consent in accordance with Art. 6 Para. 1 lit. a) GDPR.
  15. The following data is collected from participants by ART BRÜT and is used to carry out and process the vote and the competition: email address, name, postal address and telephone number in the event of a win. Only the technically and functionally necessary data is collected in accordance with our general data protection declaration . If further data is collected, then only with express consent.
  16. The personal data transmitted will be used exclusively for the implementation and processing of the campaign and will not be passed on to third parties, except to the third parties employed to process the campaign, who must process and use the data for the purpose of the campaign. The personal data of the participants will be deleted after the end of the campaign. The winners' data will be deleted after the legally prescribed retention periods have expired and blocked for this period. The participants agree to this storage and the associated transmissions between the organizer and service providers. The data processing can be revoked at any time without giving reasons and its deletion can be requested. However, this leads to exclusion from participation in the competition.
